Criminal Appeals -- State Court
Sometimes mistakes are make and a new trial and/or appeal is needed. In Georiga you have thirty days to file a notice of appeal or you lose your right to appeal the verdict or ruling of the Court. This thirty day period is stayed (stopped) if a Motion for New Trial is filed.

 

Usually a shall Motion for New Trial is filed to preserve the time lines and a copy of the trial transcript is order. An amended Motion for New Trial is filed detailing the errors that were made during the trial.


A hearing is held, the Judge hears evidence and argument then makes the decision to grant or deny the Motion for New Trial. If the Motion is granted, a New Trial date will be set.

 

If the Motion is denied a Notice of Appeal must be filed within thirty days of the Judge's decision being filed or the right to appeal will be lost. Whether a New Trial is granted or denied cousel may request a bond while either is pending.
